If you do not agree to these Terms, please do not use our services.

- "Platform" refers to the Floogos iPaaS (Integration Platform as a Service) software, including all features, tools, and functionalities. - "User" refers to any individual or entity that accesses or uses the Platform. - "Account" refers to the user registration that provides access to the Platform. - "Services" refers to all integration, automation, and related services provided through the Platform. - "Content" refers to any data, information, or materials uploaded, transmitted, or processed through the Platform. - "Subscription" refers to the paid plan that grants access to Platform features.

By creating an account, accessing, or using the Floogos Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. You also agree to comply with all applicable laws and regulations. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4.1 Account Creation To access certain features of the Platform, you must create an account. You agree to: - Provide accurate, current, and complete information during registration - Maintain and promptly update your account information - Keep your password secure and confidential - Notify us immediately of any unauthorized access to your account 4.2 Account Responsibility You are responsible for all activities that occur under your account. Atlasify Systems LLC is not liable for any loss or damage arising from your failure to maintain the security of your account. 4.3 Age Requirements You must be at least 18 years old to create an account and use our Services.

5.1 Platform Features Floogos provides an integration platform that enables users to: - Connect and integrate third-party applications and services - Create automated workflows and data pipelines - Transform and process data between systems - Monitor and manage integrations through dashboards - Access AI-powered workflow creation assistance (Floo AI) 5.2 Service Availability We strive to maintain 99.9% uptime for our Platform. However, we do not guarantee uninterrupted access and may perform maintenance that temporarily affects availability. We will provide reasonable notice for planned maintenance when possible. 5.3 Service Modifications We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

6.1 Subscription Plans Access to certain Platform features requires a paid subscription. Subscription details, including pricing and features, are available on our pricing page. 6.2 Payment Terms - Payments are processed through Stripe, our third-party payment processor - Subscription fees are billed in advance on a monthly or annual basis - All fees are non-refundable except as expressly stated in these Terms - You authorize us to charge your payment method for all applicable fees 6.3 Price Changes We may change our prices at any time. Price changes will take effect at the start of your next billing cycle. We will provide at least 30 days' notice of price increases. 6.4 Taxes You are responsible for all applicable taxes. Prices do not include taxes unless otherwise stated.

7.1 Permitted Use You agree to use the Platform only for lawful purposes and in accordance with these Terms. 7.2 Prohibited Activities You may not: - Use the Platform for any illegal purpose or to violate any laws - Transmit viruses, malware, or other harmful code - Attempt to gain unauthorized access to our systems or other users' accounts - Interfere with or disrupt the Platform's operation - Reverse engineer, decompile, or disassemble the Platform - Use the Platform to send spam or unsolicited communications - Resell or redistribute the Platform without authorization - Use the Platform to process or store sensitive personal data without appropriate safeguards - Violate any third-party rights, including intellectual property rights 7.3 Enforcement We reserve the right to investigate and take appropriate action against violations of these Terms, including suspending or terminating accounts.

8.1 Platform Ownership The Platform, including all software, content, features, and functionality, is owned by Atlasify Systems LLC and protected by intellectual property laws. You receive no ownership rights to the Platform. 8.2 License Grant Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business purposes. 8.3 User Content You retain ownership of any content you upload to the Platform. By uploading content, you grant us a license to process, store, and transmit that content as necessary to provide the Services. 8.4 Feedback If you provide feedback or suggestions about the Platform, you grant us the right to use that feedback without restriction or compensation.

9.1 Privacy Policy Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. 9.2 Data Security We implement appropriate technical and organizational measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security. 9.3 Data Processing You are responsible for ensuring that your use of the Platform complies with applicable data protection laws. You must have appropriate legal bases for processing personal data through our Platform.

10.1 Integrations The Platform allows integration with third-party services. Your use of third-party services is subject to their respective terms and conditions. 10.2 No Endorsement We do not endorse or assume responsibility for third-party services. We are not liable for any issues arising from your use of third-party services. 10.3 API Changes Third-party services may change their APIs or terms at any time, which may affect Platform functionality. We are not responsible for such changes.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: - MERCHANTABILITY - FITNESS FOR A PARTICULAR PURPOSE - NON-INFRINGEMENT - ACCURACY OR RELIABILITY OF RESULTS WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: 12.1 Exclusion of Damages ATLASIFY SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. 12.2 Liability Cap OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. 12.3 Essential Purpose THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

You agree to indemnify, defend, and hold harmless Atlasify Systems LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: - Your use of the Platform - Your violation of these Terms - Your violation of any third-party rights - Your Content uploaded to the Platform

14.1 Termination by You You may terminate your account at any time by contacting us or through your account settings. Termination does not entitle you to a refund of any fees paid. 14.2 Termination by Us We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Reasons for termination may include: - Violation of these Terms - Non-payment of fees - Conduct that we determine is harmful to other users or our business - Request by law enforcement or government agencies 14.3 Effect of Termination Upon termination: - Your right to access the Platform immediately ceases - We may delete your account data after a reasonable period - Provisions that should survive termination will remain in effect

15.1 Governing Law These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. 15.2 Dispute Resolution Any disputes arising from these Terms or your use of the Platform shall be resolved through: 1. Good faith negotiation between the parties 2. If negotiation fails, binding arbitration in accordance with the rules of the American Arbitration Association 3. Arbitration shall take place in Delaware, USA 15.3 Class Action Waiver YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS.

16.1 Entire Agreement These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Atlasify Systems LLC regarding the Platform. 16.2 Severability If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. 16.3 Waiver Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. 16.4 Assignment You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction. 16.5 Modifications We may modify these Terms at any time. We will notify you of material changes by email or through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
